TOP SHOT PLAYERS TERMS & CONDITIONS

1. ABOUT THESE TERMS
These Terms & Conditions govern your use of the Top Shot Players website and the purchase of products from Top Shot Players ("TSP", "we", "our", "us").
By accessing our website and/or placing an order, you agree to be bound by these Terms & Conditions.

2. PRODUCTS
Top Shot Players products are collectible items designed for display, recreation and entertainment.
All product images, renders, promotional materials, prototypes and packaging designs are provided for illustrative purposes only. Final products may differ from promotional materials due to:
• Manufacturing processes
• Production improvements
• Packaging updates
• Material substitutions
• Paint application methods
• Colour variation
• Product numbering
• Limited edition production requirements
Such variations do not constitute defects.
Top Shot Players reserves the right to modify, improve, update or alter product specifications, packaging, materials, colours, artwork, accessories, inserts, tooling, manufacturing methods or component suppliers without notice, provided such changes do not materially alter the intended function of the product.
3. LIMITED EDITIONS AND NUMBERED COLLECTIBLES
Many Top Shot Players products are limited edition collectibles.
Minor variations between units are expected and form part of the collectible nature of the product.
Examples include:
• Paint finish variation
• Paint placement variation
• Number placement variation
• Minor moulding marks
• Surface texture variation
• Packaging variation
• Assembly variation
These characteristics do not constitute manufacturing defects. Number allocations are random unless otherwise specifically advertised. We do not guarantee specific serial numbers.
4. PRE-ORDERS
Certain products may be sold on a pre-order basis.
Estimated production and delivery dates are estimates only.
Customers acknowledge that manufacturing, freight, customs clearance, supplier delays, weather events and other circumstances may impact delivery timing.
By placing a pre-order, you accept that delivery dates may change.
Pre-orders may not be cancelled once manufacturing has commenced unless required by applicable law.
5. PRICING
All prices are displayed in the currency shown at checkout.
Prices may change without notice.
Promotional pricing may be limited to specific time periods or inventory allocations.
Obvious pricing errors may result in cancellation of an order and a full refund.
6. SHIPPING
Shipping charges are calculated at checkout unless otherwise stated.
Customers are responsible for providing accurate shipping information.
Top Shot Players reserves the right to contact customers regarding additional shipping charges where delivery destinations are remote, regional, island-based or otherwise significantly exceed standard freight assumptions.
If additional shipping costs are not accepted, the order may be cancelled and refunded.
Delivery estimates are not guaranteed.
MULTIPLE WAREHOUSES AND SPLIT SHIPMENTS
Top Shot Players products may be fulfilled from multiple warehouses, fulfilment centres, manufacturing facilities or third-party logistics providers located in different countries.
Where an order contains multiple products, Top Shot Players may elect to ship products separately.
Customers acknowledge that:
• Items within a single order may arrive in separate shipments;
• Separate tracking numbers may be issued;
• Products may arrive on different dates;
• Products may be shipped from different countries or fulfilment locations;
• Shipping estimates may vary between products.
Additional shipping charges will not be applied for split shipments initiated by Top Shot Players.
Top Shot Players shall not be liable for delays resulting from the use of multiple fulfilment locations.
FULFILMENT AND DELIVERY ESTIMATES
Any delivery dates, production schedules, fulfilment estimates or shipping estimates provided by Top Shot Players are estimates only.
While we endeavour to meet all published timelines, actual fulfilment dates may vary due to factors outside our reasonable control, including:
• Manufacturing delays;
• Supplier delays;
• Freight disruptions;
• Port congestion;
• Customs inspections;
• Carrier delays;
• Weather events;
• Industrial action;
• Government actions;
• Force majeure events.
Customers acknowledge that delivery dates are not guaranteed and shall not constitute a material term of any purchase agreement.
Delays arising from the above circumstances shall not constitute grounds for cancellation, chargeback, compensation or damages except where required by applicable law.
7. IMPORT DUTIES AND TAXES
Top Shot Players is not responsible for customs delays or charges imposed by local authorities.
Prices do not include import duties, customs charges, VAT, GST or other taxes unless expressly stated at checkout. Customers are responsible for any such charges imposed by their local authorities.
8. DAMAGED, DEFECTIVE OR INCORRECT PRODUCTS
If you believe your product is damaged, defective or incorrect, you must contact Top Shot Players within 14 days of delivery.
Claims must include:
• Order number
• Description of issue
• Clear photographs of the product
• Clear photographs of packaging
• Any other information reasonably requested by Top Shot Players
All claims are subject to review through our Quality Control process.
Failure to provide adequate evidence may result in the claim being denied.
Top Shot Players reserves the right to determine whether a reported issue constitutes:
• Manufacturing variation
• Cosmetic variation
• Shipping damage
• Manufacturing defect
The outcome of the review process shall be determined by Top Shot Players acting reasonably.
9. REMEDIES FOR APPROVED CLAIMS
Where a claim is approved, Top Shot Players may, at its sole discretion:
• Provide replacement parts
• Provide a replacement product
• Provide store credit
• Provide a partial refund
• Provide a full refund
The remedy selected may depend on:
• Product availability
• Severity of issue
• Collectibility status
• Customer location
• Freight costs
Top Shot Players is not obligated to provide both a replacement and a refund.
10. RETURNS
Due to the collectible nature of our products, returns are generally not accepted for:
• Change of mind
• Minor cosmetic variation
• Paint variation
• Packaging variation
• Limited edition numbering preferences
• Collector preference
Where a return is approved, the product must be:
• Unused
• In original condition
• In original packaging
• Include all accessories and inserts
Return shipping costs are the responsibility of the customer unless otherwise required by law.
11. RETURN OF DEFECTIVE PRODUCTS
Top Shot Players may elect not to require return of defective products where return freight costs are unreasonable.
In such cases we may request:
• Additional photographs
• Video evidence
• Destruction of the product
• Removal of serial numbers
• Other reasonable verification measures
Failure to comply may result in the claim being denied.
12. LOST OR STOLEN PARCELS
Customers are responsible for ensuring a secure delivery location.
Claims relating to lost parcels must be submitted within 14 days of the expected delivery date.
Top Shot Players will assist with carrier investigations where appropriate.
Carrier investigations may take several weeks to complete.
13. PRODUCT SAFETY
Products may contain:
• Small parts
• Magnets
• Metal components
Products are not intended for children under 14 years of age unless specifically stated otherwise.
Adult supervision is recommended.
14. INTELLECTUAL PROPERTY
All trademarks, logos, product names, character designs, artwork, videos, photographs, product designs and website content remain the property of Top Shot Players or its licensors.
No content may be copied, reproduced, modified, distributed or commercially exploited without prior written consent.
15. USER GENERATED CONTENT
By tagging, mentioning, uploading or submitting content relating to Top Shot Players products, you grant Top Shot Players a perpetual, worldwide, non-exclusive, royalty-free licence to use, reproduce, distribute and publish such content for promotional and marketing purposes.
16. FRAUD AND ABUSE
Top Shot Players reserves the right to:
• Refuse orders
• Cancel orders
• Restrict purchases
• Limit quantities
where fraud, abuse, reseller activity, chargeback abuse, technical errors or suspicious activity is suspected.
17. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Top Shot Players shall not be liable for any indirect, consequential, incidental or special damages arising from the purchase or use of our products.
Our maximum liability shall not exceed the amount paid by the customer for the affected product.
Nothing in these Terms excludes any rights that cannot be excluded under applicable consumer protection legislation.
18. AUSTRALIAN CONSUMER LAW
Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law or any other applicable consumer protection legislation.
19. GOVERNING LAW
These Terms & Conditions are governed by the laws of Western Australia.
Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Western Australia.
